AGREEMENT TO OUR LEGAL TERMS

We are Komorebi Trading Cards AB, operating as Komorebi Cards ("Company," "we," "us," or "our"). We are registered in Sweden, with our office located at Klenavägen 59, 13669 Vendelsö. Our corporate ID number is 559449-0988 and our VAT number is SE559449098801. The company's seat is located in Haninge municipality, Stockholm county. Our telephone number is +46 7634 340 23.
 
Our store currently operate on Tradera and Cardmarket (collectively, the "Platforms") and utilize their services for all transactions and product listings. Our website, https://komorebicards.com (the "Site"), is provided for informational purposes and links directly to our stores on these Platforms. Together, these constitute our "Services."
 
Our specialty is the sale of Japanese collectible trading cards and related accessories through e-commerce platforms, as well as online marketplaces.

Purchases are carried out in Swedish or English, according to Swedish and EU law, and in accordance with the terms and conditions of the respective platforms.

By accessing and using our Services, you agree to be bound by these Legal Terms. IF YOU DO NOT AGREE WITH THESE LEGAL TERMS, PLEASE DO NOT USE THE SERVICES AND DISCONTINUE USE IMMEDIATELY.
 
Supplemental terms or documents may be posted on the Services from time to time and are hereby incorporated by reference into these Legal Terms. We reserve the right to update or modify these Legal Terms at our discretion. We will notify you of any changes by updating the "Last Updated" date of these Legal Terms, and you waive any right to receive specific notice of each change. Your continued use of the Services after the revised Legal Terms are posted signifies your acceptance of the changes.
 
The Services are intended for users who are at least 18 years old.

1. OUR SERVICES

Our Services are not intended for distribution or use in any jurisdiction or country where such distribution or use would be contrary to law or regulation, or which would subject us to any registration requirement within such jurisdiction or country. Users who access the Services from other locations do so on their own initiative and are responsible for compliance with local laws, if applicable.​
 
2. USER REPRESENTATIONS

By using the Services, you represent and warrant that:
 

  • All information you submit will be true, accurate, current, and complete.

  • You will maintain the accuracy of such information and promptly update it as necessary.

  • You have the legal capacity to comply with these Legal Terms.

  • You are not a minor in the jurisdiction in which you reside.

  • You will not access the Services through automated or non-human means.

  • You will not use the Services for any illegal or unauthorized purpose.

  • Your use of the Services will not violate any applicable law or regulation.

  • If you provide any information that is untrue, inaccurate, not current, or incomplete, we reserve the right to refuse current or future use of the Services.

 
3. PRODUCTS

We strive to accurately display our products' colors, features, specifications, and details as accurately as possible. However, we do not guarantee that these will always be accurate, complete, reliable, current, or error-free. Products are subject to availability, and we reserve the right to discontinue any products at any time. Prices for all products are subject to change.
 
4. PURCHASES AND PAYMENT

The platforms offer the payment services.
​
You agree to provide accurate purchase and account information for all purchases made via the Services and to promptly update your information as necessary.
 
As a general rule, the price stated on the sales listing applies when purchasing goods with a fixed price. When bidding, the price of the winning bid applies.
 
All prices as well as shipping fees always include your country's VAT rate for consumers in cases where profit margin taxation (VMB*) does not apply. (*VMB may apply for citizens of EU countries. International purchases are VAT free). If you are a registred business in the EU, VAT will be excluded if you prior your purchase provide us with your company's VAT number.

Payments on Tradera are to be made in SEK and payments on Cardmarket are to be made in EUR.
 
You agree to pay all charges at the prices then in effect for your purchases and any applicable shipping fees. We reserve the right to correct any errors or mistakes in pricing, even if we have already requested or received payment.
​
In the event of late payment, we reserve the right to charge a reminder fee of either 60 SEK (or the equivalent in EUR) as well as an annual late payment interest based on the Swedish central bank's current reference rate + 8 percentage points on the outstanding amount. We reserve the right to hand over orders that have not been paid on time to the platforms or debt collection agencies. If the customer does not make full payment by the due date, we reserve the right to refuse the customer further orders and/or deliveries.

As our general rule, payments must be completed within 7 days on Tradera and within 14 days on Cardmarket.

 

Purchased goods remain our property until full payment has been received by us.

5. FORCE MAJEURE
​
We reserve the right to not fulfill the agreements if our performance is prevented or substantially impeded by circumstances beyond our control and which were unforeseeable. Some examples are, but not exclusive to; fires, weather phenomena, terrorist attacks, war, mobilization, seizure of goods, lack of means of shipping, strike, lockout and blackout.

6. SHIPPING & RETURN POLICY

7. PROHIBITED ACTIVITIES
​
You may not use the Services for any purpose other than that for which we make the Services available. Prohibited activities include, but are not limited to:
 

  • Systematically retrieving data from the Services to create a collection, compilation, database, or directory without our permission.

  • Engaging in unauthorized framing of or linking to the Services.

  • Uploading or transmitting viruses, Trojan horses, or other material that interferes with the use, features, functions, operation, or maintenance of the Services.

  • Using the Services in a manner inconsistent with any applicable laws or regulations.

  • Engaging in any automated use of the system, such as using scripts.

8. THIRD-PARTY WEBSITES AND CONTENT

Our Services may contain links to third-party websites and content. We are not responsible for the content or practices of third-party websites. If you access third-party websites, you do so at your own risk, and these Legal Terms no longer govern. The exception is the websites of our Tradera and Cardmarket stores.
 
9. SERVICES MANAGEMENT

We reserve the right to:
 

  • Monitor the Services for violations of these Legal Terms.

  • Take appropriate legal action against anyone who violates the law or these Legal Terms.

  • Manage the Services to protect our rights and property and facilitate the proper functioning of the Services.

 
10. PRIVACY POLICY

We care about data privacy and security. Please review our Privacy Policy here. By using the Services, you agree to be bound by our Privacy Policy.

11. MODIFICATIONS AND INTERRUPTIONS

We reserve the right to change, modify, or remove the contents of the Services at any time or for any reason at our discretion without notice.
 
12. GOVERNING LAW
​
These Legal Terms are governed by and interpreted according to the laws of Sweden. If you are a consumer in the EU, you possess the protection provided by the mandatory provisions of the law in your country of residence. You accept that any disputes arising in connection with these terms or the purchase of products shall only be adjudicated by the courts of Sweden. This provision applies provided it does not conflict with applicable consumer protection laws that grant the customer the right to choose a court in their home country.
 
13. DISPUTE RESOLUTION

If you have any questions or concerns regarding complaints, right of withdrawal, or anything else related to your purchase, you should start by contacting us on via the platforms messaging services, or komorebi.tradingcards@gmail.com so we can resolve the matter.
 
If you are still not satisfied with your case after contacting us, you can escalate the dispute to the platforms.
 
If you live in Sweden you can submit a complaint to the Swedish National Board for Consumer Disputes, Allmänna reklamationsnämnden (ARN) on arn.se.
 
If you live in another EU country you could submit a complaint via the EU web-based platform for Online Dispute Resolution (ODR) on ec.europa.eu/consumers/odr. 
 
We undertake to follow ARN and ODR resolutions.

14. CORRECTIONS
​
There may be information on the Services that contains typographical errors, inaccuracies, or omissions. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update the information on the Services at any time without prior notice.

15. USER DATA
​
We will maintain certain data that you transmit to the Services for managing performance. However, you are solely responsible for all data you transmit or that relates to any activity you have undertaken using the Services.​
 
16. ELECTRONIC COMMUNICATIONS
​
Visiting the Services, sending us emails, and completing online forms constitute electronic communications. You consent to receive electronic communications and agree that all agreements, notices, disclosures, and other communications we provide to you electronically satisfy any legal requirement that such communication be in writing. We will never send you advertising or similar communications without your permission.
 
17. MISCELLANEOUS

These Legal Terms constitute the entire agreement between you and us and also apply to our Privacy Policy, Shipping and Return Policy, and Cookie Policy. Our failure to exercise or enforce any right or provision of these Legal Terms shall not be construed as a waiver of such right or provision. If any provision of these Legal Terms is deemed unlawful, void, or unenforceable, that provision shall be severable from these Legal Terms and shall not affect the validity and enforceability of any remaining provisions.
